PREAMBULE

The present conditions of sale are concluded on the one hand by the company ON PARLE DE VOUS, Limited Liability Company with capital of 32,000 €, whose registered office is 111 boulevard de Sébastopol 75002 Paris, registered in the Paris Trade Register under number 432 539 260, hereinafter referred to as “ON PARLE DE VOUS”, and on the other hand, by any natural or legal person wishing to make a purchase via the website http://www.onparledevous.fr/ hereinafter referred to as “the Client”.

WE ARE TALKING ABOUT YOU reserves the right to modify these Terms and Conditions of Sale at any time by publishing a new version on the Site. The applicable General Terms and Conditions of Sale are those in force on the Site on the date the Customer places the order;being specified that any order for a Product offered on the Site implies full and complete compliance of the Customer with the General Terms and Conditions of Sale in force at the time of placing its order.

The purpose of these General Conditions of Sale is to define the rules applicable in the context of the sale of products branded ON PARLE DE VOUS on the site, any major natural person or minors with parental permission, non-commercial, with the legal capacity to contract, exclusively domiciled in the countries delivered by http://www.onparledevous.fr/ making a Product purchase on the Site. 



ARTICLE 1 • PURPOSE

The purpose of these General Conditions of Sale is to define the conditions under which the Products are marketed by ON PARLE DE VOUS to the Customer. They thus regulate the various stages of realization of the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.

ARTICLE 2 • PRODUCTS

The Products offered for sale by ON PARLE DE VOUS are those appearing on the Site on the day of its consultation by the Customer. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, the photograph, the available sizes and colors, the composition, as well as the particular characteristics. Minimal differences between a product and its photograph may exist, depending in particular on the resolution and definition of the colours of the user’s screen.

SPEAKING OF YOU undertakes to deliver within the limits of the available stocks of Products meeting the requirements in force relating to the safety and health of persons in accordance with the European provisions, and, in particular, legislation on controlled chemicals.

Information on the availability of products is provided at the time of placing the order. In the event of a product unavailability after placing the order, ON PARLE DE VOUS undertakes to inform the customer by e-mail as soon as the information is received as soon as possible. The order for this product will be automatically cancelled, the rest of the order remaining firm and final.

The refund will be made directly to the customer’s bank account no later than 30 days from the payment of the sums paid by the customer.


ARTICLE 3 • PRICES

The prices are indicated in Euros all taxes included, excluding delivery costs; being specified that the value added tax is that in force on the French metropolitan territory on the day of the validation of the order.

The prices applied are those communicated on the Site, are guaranteed within the limits of available stocks and confirmed to the Customer when validating the order.

The delivery costs are communicated to the Customer on the order summary before the validation of the order and are expressed all taxes included. These costs shall be borne by the Customer and shall be invoiced in addition to the selling price of the Products.

The transfer of the risks of loss and deterioration of the Products will be carried out after delivery and receipt of the Products by the Customer.

We reserve the right to modify our prices at any time but we undertake to apply the rates indicated on the Site at the time of your order.

We inform you that in case of display of an erroneous, obviously derisory price (vil price), whatever the reason (computer bug, manual error, technical error.), the order -even validated by us- will be cancelled, which we will inform you as soon as possible. You will then be able, if you wish, to retake your order at the correct and exact price.



ARTICLE 4 • ORDERING AND PAYMENT OF PRODUCTS



• 4.1 PLACING AN ORDER

The Customer materializes its order by completing the next 5 steps

Step 1: During the first order, the customer will have to create a customer account by filling in a form containing the following mentions: civility, surname, first name, complete delivery address, e-mail and telephone number. It then specifies the chosen delivery method. Subsequently, the customer will have to identify himself, by entering his e-mail and password. The customer is informed and accepts that the entry of these two identifiers (e-mail address and password) is proof of his identity and manifests his consent.The customer declares that he is 18 years old or, failing that, has a parental authorisation allowing him to proceed with the order on the site.

Step 2: The Customer selects the selected Products and adds them to the basket after selecting the desired size and color.

At any time he will have the possibility:

To obtain a summary of the selected products by clicking on the link at the top right of the "My Cart" screen with the indication of the number of Products it contains
Continue your purchases by clicking on the "Continue my purchases" link
Complete your selection and place your order by clicking on the “Order” link


Step 3: The Customer checks the contents of his shopping cart by clicking on "order" in order to have access to the summary of his order. The Customer can then modify his order (Product, size, quantity).

The total TTC amount of the order, distinguishing on the one hand the price due under the Products and on the other hand the delivery costs, is then indicated in the summary.Once the order has been verified and if necessary modified, the Customer validates his shopping cart in order to finalize his order by clicking on "order" again.

If the Customer has an advantage code, it must enter it in the location provided for that purpose in order to benefit from it.

 

Step 4: the Customer enters the delivery and billing details

Apart from the date of birth, the address supplement and the delivery information, all the fields are necessary for the finalization of the order; being specified that unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address.

If the Customer has already placed an order on the Site, it has a customer account. In such a case, he will only identify himself with his email address and password.

The Customer then checks all the information and clicks "validate" to continue its order.

 

• 4.2 ORDER CONFIRMATION

Upon acceptance of the Customer’s payment, the Customer will receive an e-mail confirming its order, summarizing all the items ordered, the billing and delivery address and the delivery date.

The validation of the order by the Customer and the confirmation of the order sent to the Customer by e-mail by ON PARLE DE VOUS following the acceptance of the payment shall constitute the conclusion of a sales contract between the Parties and acceptance of the Terms and Conditions of Sale.

The Customer who has placed an order will have the possibility to print his invoice by logging on to the Site in the space followed by order provided for this purpose.

ON PARLE DE VOUS reserves the right not to validate the order in case of:

abnormal or abusive claims,
abnormal controls for the quantities ordered,
abnormal or abusive exchanges and returns,
existing dispute(s) with the client.
We reserve the right to refuse an order for a legitimate reason, for example in the following circumstances:

The item ordered is no longer in stock;
We were unable to obtain authorization to pay;
An error has been identified in product information, including price or promotion;and/or
If we suspect fraudulent activity.
In any case we will inform you accordingly, and if the payment of your order has already been made, we will refund you without delay and in any case within 30 days.

For all orders greater than 120 € ON PARLE DE VOUS may request proof of identity before the preparation and dispatch of the order.

• 4.3 PAYMENT

The price of the purchased Products is payable in cash, in full on the day of placing the order by the Customer. Payment is made online using the following payment methods (Carte Bleue, Visa, Mastercard, Paypal) at the time the order is validated by the Customer.

The request to authorize the withdrawal of the card is made at the time of the validation of the order on the Site, except in case of server unavailability. ON PARLE DE VOUS reserves the right to make a new request for authorization of withdrawal in the event that the first could not have ended due to unavailability of the servers.

In the event of a default of payment, an incorrect address or any other problem on the Customer’s account, ON PARLE DE VOUS reserves the right to block the Customer’s order until the problem is resolved.

In case of fraudulent use of his bank card on the Site, the Customer is invited to contact ON PARLE DE VOUS at the following number: 01 40 28 18 19, from Tuesday to Friday, from 10 am to 12 pm and 2 pm to 5 pm or in the "CONTACT" section of the site for individuals .

The transactions carried out on the site are secured by the Sogenactif payment system, a system developed by Société Générale. company with capital of 976,447,673.75 euros whose registered office is located at 29 boulevard Haussmann 75009 Paris and registered with the RCS de Paris N° 552 120 222.

All information exchanged to process the payment is encrypted using the Secure Socket Layer (SSL) protocol. These data cannot be detected, intercepted or used by third parties. At no time does the Customer’s financial data pass through the ON PARLE DE VOUS computer system. Sogenactif checks that the connection with the Client’s browser is secure before sending the payment form to the banking institution that carries out the financial transaction.

Since Sogenactif is a technical service provider, it does not take on the challenges related to orders that are handled directly by ON PARLE DE VOUS as specified above or, where applicable, by the Client’s bank. 

• 4.4 ARCHIVING OF THE ORDER

The order confirmation is recorded on the registers of ON PARLE DE VOUS, which are kept on a reliable and durable medium. The Customer agrees that the order confirmation shall be considered as proof of the contractual relations between the Parties.


ARTICLE 5 • DELIVERY

Time of delivery:

Any order confirmed on the Site are in no way opposable, any order recorded from Monday to Thursday will be processed the same day; after 15 hours, it will be processed the next day.Orders placed on Fridays, Saturdays and Sundays will be processed on Mondays or Tuesdays (depending on the carrier); it will be noted that orders placed on a holiday will be processed on the following business day.

In the event that the delivery period is exceeded, not justified by a case of force majeure, the Customer may request the resolution of the sale and obtain within a maximum period of 30 days the refund of the sums paid at the time of the sale.

We endeavour to deliver orders within 10 working days for delivery to Metropolitan France, and 20 working days for delivery to any other destination, from the day following payment of the order.

However, during periods of high activity, deliveries may take longer. We remind you that Saturday and Sunday are not counted as working days. If your order has not arrived within ten working days, please contact our Customer Service:

Please also note that no change of delivery address can be made after your order has been placed.

ON PARLE DE VOUS reserves the right to refuse to deliver orders from individuals to collective addresses such as offices, care facilities, stays.In case of delivery to a collective address, the customer acknowledges that the obligation of ON PARLE DE VOUS for the delivery of the order stops at the actual delivery to the collective address indicated in his order form, whereas the consignment is not received by the final consignee but by a third party.

For orders outside France, when the package destined for export reaches its destination, it will be up to the recipient to pay the taxes or customs duties that apply to the country of destination. Local authorities can provide useful information.

ARTICLE 6 • ORDER RECEIPT – CLAIMS - RETURNS

We do our best to ensure that all of our products meet the high quality criteria our customers expect. However, despite the special care in order processing, some products may pass through our audits and inspections.Therefore, upon receipt of its order, the customer is required to verify the compliance of the Products received in execution of its order at the time of delivery.

In case of damaged packages, we ask you not to receive a damaged package (packaging bearing visible traces of opening and/or deterioration): it must be refused. In fact, packages leaving the warehouses of onparledevous.fr are always impeccable, and must be delivered to you in this condition. If no reservation has been made, we will not be able to take into account any disappearances, nor will we be able to make compensation.

Any anomaly concerning delivery such as:

missing products,
deteriorated products,
products that do not comply with the order, must be notified the same day of receipt or at the latest 3 days after receipt, to our Customer Service:

Please include as many details as possible concerning the order and the problem encountered with the products concerned.

After this deadline, and unless there is a hidden defect, no claim will be accepted by ON PARLE DE VOUS, the Products being deemed compliant, and ON PARLE DE VOUS will be released from any liability. 

ON PARLE DE VOUS reserves the right to ask the customer to return the defective product. If the above conditions are met, SPEAKING OF YOU will then exchange, issue a credit note, refund the defective product(s), or redirect the missing product(s) (subject to the merits of the purchaser’s request).

For any non-conforming Product return, the Customer must follow the following procedure:

The customer must fill in the return form accessible from the customer area - My Orders section.
You will receive a validation by email including, on the one hand, a confirmation of return with the return voucher that the Customer must attach to his parcel, no return can be accepted without said return voucher duly completed.
the Products must be returned in their original packaging in perfect condition of resale (shoe box, plastic pouches ...), with their label and any accessories, in an impeccable condition to: E-boutique ON PARLE DE VOUS SARL – 111, boulevard de Sébastopol – 75002 Paris. Returns of clothes washed and/or worn, as well as damaged boxes will be refused.
For all returns, please keep the supporting documents. Make sure your return is properly packaged to avoid damage to products or boxes.
Once the non-compliance has been found, ON PARLE DE VOUS will offer the Client either:

the replacement of the Product(s) at the expense of ON PARLE DE VOUS, either
the reimbursement of the price of the order (price of the Products), at the latest within thirty (30) days from the day of receipt of the Product(s) that have not been submitted by the customer service department of the site ON PARLE DE VOUS.
In the event of a refund, SPEAKING OF YOU will guarantee the refund of all products made compliant, with the exception of taxes and customs duties paid by the customer at the time of delivery.

In case of abnormal or abusive claims, WE SPEAK OF YOU may refuse to serve a subsequent order.

ARTICLE 7 • RIGHT OF RETRACTION

Only orders placed on www.onparledevous.fr can be returned or exchanged by ON PARLE DE VOUS. The Customer has 14 working days from the date of receipt of its order to return the Products ordered, without justification or penalty.

For any exchange or return under the provisions of Articles L 121-16, the following procedure must be fully complied with:

The customer must fill in the return form accessible from the customer area - My Orders section.
You will receive a validation by email including, on the one hand, a confirmation of return with the return voucher that the Customer must attach to his parcel, no return can be accepted without said return voucher duly completed.

ARTICLE 8 • PERSONAL DATA

WE ARE TALKING ABOUT YOU collects a certain amount of information necessary to process orders.

This data is not only necessary for the processing of the Customer’s order by ON PARLE DE VOUS, but also to communicate to the Customer information about the brand ON PARLE DE VOUS, on the Site or make it benefit from commercial offers from ON PARLE DE VOUS; if the Customer accepts it by validating its order.

The information is strictly confidential and is indicated by an asterisk (*) when it is necessary for ON PARLE DE VOUS, and/or its service providers in the management of the Customer’s order.

Following any injunction of the legal authorities or in order to defend its rights or those of its employees, customers or any other person, WE SPEAK OF YOU may communicate these data to the organizations and authorities legally authorised.

SPEAKING OF YOU undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Customer’s personal information from being distorted, damaged or accessed by unauthorized third parties.

The Customer’s personal information is sent and stored at the host of the website located in France, the coordinates of which appear on the site in the "Legal Notice" section.

In accordance with the "Informatics and Freedom" law of 6 January 1978, as amended by the law of 6 August 2004, the Customer has the right to access, rectify, modify and delete the data concerning him.

They are the exclusive property of ON PARLE DE VOUS. The user who has a personal Internet site and who wishes to place, for personal use, on his site a simple link directly to the homepage of the Site, must necessarily ask the permission of ON PARLE DE VOUS.

On the other hand, any hypertext link referring to the Site and using the technique of framing or in-line linking is formally prohibited.

In all cases, any link, even tacitly authorized, must be removed upon simple request from ON PARLE DE VOUS.

ARTICLE 10 • COOKIES

In order to process the Customer’s order, and in order to better understand its needs and personalize the services offered on the Site, ON PARLE DE VOUS makes use of cookies. The cookie is a computer file stored on the hard drive of the Customer’s microcomputer that is intended to signal its passage on the Site.

Cookies store, the Customer’s visit time on the Site, its identity (known by its email address and password) and the contents of its basket. Once disconnected from the Site, this information is stored for 30 days before being permanently erased.

The Client may object to the registration of cookies by configuring its Internet browser. He loses any personalization of the service offered on the Site.



ARTICLE 11 • LIMITATION OF LIABILITY

Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet, particularly as regards technical performance, response times, connection, queries or transfers of information, risks of interruption, risks of virus contamination circulating on the network and generally all risks related to the use of the Internet network.

SPEAKING OF YOU can therefore under no circumstances be held liable for any direct or indirect damage resulting from a misuse or incident related to the use of the computer, access to the Internet, the maintenance or malfunction of the servers, the telephone line or any other technical connection, the Customer’s connection to the Site being under its sole responsibility.

ARTICLE 12 • FORCE MAJEURE

SPEAKING OF YOU will not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if such non-performance is caused by an event constituting a case of force majeure as defined by positive law.

In such an event, ON PARLE DE VOUS will inform the Client of the occurrence of such an event within 3 clear days of its occurrence, by e-mail.

After a period of 1 month, and in the event that the event constituting a case of force majeure persists, the order will be cancelled and will, if applicable, the subject of a refund of ON PARLE DE VOUS on the bank card used to place the order within a maximum of 30 days.



ARTICLE 13 • APPLICABLE LAW

If any of the terms of these General Terms and Conditions of Sale are declared invalid, illegal or unenforceable by a court order, the other provisions of the General Terms of Sale shall remain in force.

The General Conditions of Sale are executed and interpreted in accordance with French law.

In case of disputes, the client will first contact ON PARLE DE VOUS to obtain an amicable solution and if there is no agreement, the Paris Commercial Court will be the sole competent court.
